# AI music in ads: licences and AI labels (2026) | Lyro Music

> Can an AI song go in your ad? It depends on the tool’s licence and the platform’s AI rules. What the main tools allow, and what TikTok, Meta and YouTube ask.

# Can you use AI music in ads? Licences and AI labels (2026)

Yes, you can use AI music in an ad when two things hold: the tool’s licence allows commercial use in advertising on the plan you used, and you follow the AI rules of the platform where the ad runs. Licences differ a lot. Udio’s terms allow personal, non-commercial use only; Suno allows commercial use of songs downloaded on a paid plan; ElevenLabs’ self-serve music terms exclude film, TV and radio. TikTok requires an AI-generated disclaimer on ads whose audio is completely AI-generated. And a claim the song sings needs the same evidence as a claim on a poster.

## The licence decides where the song can go

With a commercially released track, putting music in an ad needs a sync licence, permission from the rightsholders of the song and of the recording ([PRS for Music](https://www.prsformusic.com/get-a-music-licence/commercial-music-sync-licensing)). With an AI tool there is no publisher or label to ask: the only permission you have is the tool’s own licence for what it made, so its terms decide where the song can go.

Plans and terms change. Read the current page before a campaign, especially for radio, TV or an agency working for clients.

## AI labels, platform by platform

- **TikTok ads.** An AI-generated disclaimer is mandatory for ads with images, video or audio that is completely AI-generated ([TikTok Ads Manager help](https://ads.tiktok.com/help/article/about-ad-disclaimers-in-tiktok-ads-manager)). Ads with AI content that is not disclosed are rejected or restricted ([TikTok advertising policies](https://ads.tiktok.com/help/article/tiktok-ads-policy-misleading-and-false-content)).

- **TikTok posts.** Realistic AI-generated images, audio or video must be labelled, and TikTok may add its own “AI-generated” label to uploads that carry Content Credentials ([TikTok Support](https://www.tiktok.com/support/faq_detail?id=7636670084747893268)).

- **Facebook and Instagram ads.** Meta adds an “AI info” label when it detects AI tools, and in some regions advertisers can disclose themselves ([Meta Business Help Centre](https://www.facebook.com/business/help/1010479435004531)). Its help page talks about images and video; we could not confirm how it treats AI-made audio in an ordinary ad. Political and social issue ads must disclose realistic AI audio ([Meta Business Help Centre](https://www.facebook.com/business/help/1486382031937045)).

- **Instagram Reels ads.** Meta’s specifications say Reels ads should not contain licensed music and recommend original audio ([Meta Ads Guide](https://www.facebook.com/business/ads-guide/update/video/instagram-reels)). Whether an AI song you hold a licence for counts as original audio is our reading, not Meta’s words.

- **YouTube.** Creators must disclose realistic AI content in YouTube Studio, and AI-generated music is the first example on YouTube’s list ([YouTube Help](https://support.google.com/youtube/answer/14328491)).

- **UK advertising rules.** There is no blanket legal duty to disclose AI in UK ads; the ASA advises disclosure where leaving it out would mislead, and says a disclosure does not fix a misleading ad ([Advertising Standards Authority](https://www.asa.org.uk/news/disclosure-of-ai-in-advertising-striking-the-balance-between-creativity-and-responsibility.html)).

## Claims still need proof

A song does not change the advertising rules. The FTC expects a reasonable basis, objective evidence, for every express and implied claim before the ad runs, and competent scientific evidence for health claims ([US Federal Trade Commission](https://www.ftc.gov/business-guidance/resources/advertising-faqs-guide-small-business)). The CAP Code asks UK advertisers to hold documentary evidence for objective claims before the ad goes out, and not to mislead by leaving out significant limitations ([UK CAP Code](https://www.asa.org.uk/type/non_broadcast/code_section/03.html)).

Two habits help: sing only benefits your product page already states, and keep the evidence next to the lyric. Lyro’s [Song Ad](https://lyromusic.com/features/song-ad) builds the first habit in: each claim in its brief carries the words from your page that back it, and claims the page does not state are left out. The customer in the song is a character, so never present the song as a real customer’s review.

## Owning the song is a different question

A licence lets you use a song; copyright decides whether anyone can stop others copying it. The US Copyright Office says AI output is protected only where a human author determined enough of its expressive elements, and prompts alone are not enough ([US Copyright Office](https://www.copyright.gov/newsnet/2025/1060.html)). So an AI jingle may not be yours exclusively, and another user may get something similar. If exclusivity matters, write the lyrics yourself, change the arrangement, and keep a record of what you did.

## A checklist before the ad runs

- The plan you used allows commercial use in this kind of ad, and you still have the download.

- Every claim in the lyrics is true and you hold the evidence.

- No real artist’s voice, name, melody or lyrics, and no other brand’s jingle.

- The ad carries the AI label the platform asks for.

- The song is presented as a song, not as a customer testimonial.

- The length fits the placement, with a short cut for short spots.

- The file you upload is the one you checked, with the name sung right.

### Can I use Suno songs in ads?

Suno’s terms allow commercial use of songs downloaded on a paid plan, and free output is for personal use only ([Suno blog](https://about.suno.com/blog/suno-updates-tos)). Check the current terms before a campaign.

### Can I use Udio songs in ads?

Not under Udio’s current terms: output is for personal, non-commercial use only, it may not be published on platforms such as YouTube, Facebook, Instagram or TikTok, and downloads are switched off ([Udio](https://www.udio.com/terms-of-service)).

### Do I need to disclose AI music in a TikTok ad?

Yes when the audio is completely AI-generated: TikTok lists it as a case where the AI-generated disclaimer is mandatory ([TikTok Ads Manager help](https://ads.tiktok.com/help/article/about-ad-disclaimers-in-tiktok-ads-manager)).

### Is AI-generated music copyright-free?

Not in a simple sense. The tool’s licence sets what you may do with it, and in the US purely AI-generated material is not protected by copyright ([US Copyright Office](https://www.copyright.gov/newsnet/2025/1060.html)), which also means you may not be able to stop others copying it.

### Can I use a Lyro song in an ad?

Yes: every paid plan includes a commercial licence for what you make, subject to Lyro’s terms and its model providers’ policies.
